JUDICIAL SALE OF MORTGAGED LANDS
Pursuant to the Order of the Master in Chambers, the following property is offered for sale by the Court of King’s Bench of Alberta by soliciting tenders subject to the restrictions in the existing certificate of title, namely:
CONDOMINIUM PLAN 0426479
UNITS 69 AND 113
AND 105 UNDIVIDED 100,000TH SHARES IN THE COMMON PROPERTY
EXCEPTING THEREOUT ALL MINES AND MINERALS
The subject property is a 1 bedroom apartment style condominium with separately titled underground parking stall located in the Belvedere area of Edmonton. For further details, interested parties may refer to the affidavit of value filed in these proceedings by contacting the plaintiff’s solicitors Minsos Stewart Masson.
The following encumbrances will remain on the title to the land following sale: none.
This is a judicial sale and there is no warranty whatsoever with respect to the premises, its size, location or condition. Tenders are made for purchase of the property on an “as is - where is” basis, and tenderer must satisfy himself/herself as to the size, condition and location of the property. No chattels are included with the tender sale. The asking price for the property is $100,000.00.
Prospective purchasers are not entitled to inspect the property and must not disturb the occupants of the property.

Stewart, by email addressed to dstewart@minsoslawyers.com, facsimile to (780) 465-6717, or delivered to #220, 8723 - 82 Avenue Edmonton AB T6C 0Y9, along with a certified cheque or money order or etransfer payable to Minsos Stewart Masson for 10% of the amount of the tender must be in the hands of the law firm before noon on August 4, 2023.
The highest or any tender will not necessarily be accepted. Tenders shall be irrevocable and shall be dealt with by the Court. Cheques of unsuccessful tenderers shall be returned to them.
The next hearing in this action will be held on August 8, 2023, in Application Judge's Chambers in the Court of King’s Bench of Alberta In Person at the Edmonton Court House in Edmonton, Alberta at 10:00 a.m. or so soon thereafter as counsel for the plaintiff may be heard, at which time the plaintiff may apply for a foreclosure order, an order for sale to plaintiff, or an order accepting or rejecting any tender received.
